Wrongful Death

However difficult it is to lose a loved one, loss of a loved one to a wrongful death is even more traumatic. A wrongful death is a death that was caused by someone's negligence or wrongful actions.

A wrongful death lawsuit is a legal action that occurs as a civil action against a person being responsible for the death. The claim is usually filed by the family close, and that a dead person can not file a claim, and claims a certain amount of negligence or wrongdoing by the person being accused (also known as the defendant). Statues of filing a wrongful death lawsuit vary somewhat from state to state, however they are all very similar in nature and cover a variety of categories of manslaughter stemming from a death occurring at from personal injury.

Since matter is usually a civil court, rather than a criminal court, the burden of proof is simply a preponderance of the evidence, rather than prove the case beyond reasonable doubt as required in the criminal court system. It is because of this difference is much easier for a family to seek justice for the death of your loved one this way it would be to encourage prosecution. That said, it is impossible for a person criminally prosecute and seek damages. It is not uncommon for someone to seek a murder, manslaughter, or convicted of criminally negligent homicide, while civilly sued for wrongful death.

A wrongful death resulting from product liability means that death occurred as a direct result of a defective product. A product can be classified as any other consumer goods such as pharmaceuticals, automobiles, equipment, and many other products. There have been numerous product liability claims filed against companies for defective tires tires that were fatal automobile accidents, as well as automotive companies of the deaths that occurred due to equipment malfunction or failure of the seat belt.

A wrongful death as a result of defective drugs is another common case seen in court today. Many of the drugs on the market today have numerous side effects that can lead to serious complications and death. When this happens, the manufacturer of the drug can be beaten with a wrongful death lawsuit.

A wrongful death resulting from toxic exposure means that the person died as a result of being exposed to hazardous materials on a regular basis. This often happens in a place of work over many years. Many cases of exposure to toxic substances according to the asbestos, lead, vinyl chloride and benzene.
